Legitimacy of the Dissolution of Beliefs by Community Organizations

Article 28E paragraph (1) of the 1945 Constitution states "Every person shall be free to choose and practice religion his/her choice, one’s education, employment, citizenship, place residence within state territory, leave it subsequently return it.” In (2), everyone has right freedom believe in beliefs, express views thoughts, according conscience. The constitutional guarantees for believers can also seen 29 stating that based upon One Only God State all persons worship, each own or belief. Constitutional Court affirms adhere a belief Almighty is citizen's right, not gift from state. Therefore, obliged protect guarantee fulfillment rights it’s citizens embrace other than six religions developed Indonesia. However, dissolution beliefs actually carried out by community organizations. this study, two things will discussed namely: 1) What legal position adherents national system? 2) Do organizations have authority dissolve religious beliefs? This research normative juridical research, which problems are analyzed qualitatively.
